Security failed Charlie Kirk at Utah Valley University, Erika claims

( NewsNation ) — One year and six days after Charlie Kirk was assassinated at Utah Valley University , Erika Kirk may be planning legal action against the school, NewsNation has learned, making stunning new allegations about major security failures on campus.

A notice of claim was sent to the university from Erika Kirk ‘s lawyers, containing a shocking accusation.

According to the notice, a member of Turning Point USA texted the police chief before the event with security concerns .

“Hello Chief Long — we received this message today from the student group … There is student roof access pretty close to where (Charlie Kirk) will be set up at Utah Valley … if this is true it would be nice to either have it controlled access or allow one of my guys to be there as well if possible.”

Chief Jeff Long responded, “I got you covered.”

Retired FBI and CIA agent and NewsNation National Security Contributor Tracy Walder called it a “catastrophic mistake” and said there is no excuse for the lack of security.

“I always have said I thought Kirk was in a fishbowl in that situation. And this legal claim talks about him in a bowl,” she said. “And in a situation like that, you want to make sure all the roofs are secure and doing so wouldn’t have been a heavy lift necessarily.”

Kirk was fatally shot while appearing at an event on campus, with suspect Tyler Robinson allegedly firing the shot from a rooftop nearby.

Police began searching for a suspect after Kirk was shot, with Robinson turning himself in to authorities a day later at the urging of his family. He is facing murder charges and has pleaded not guilty.

After the shooting, NewsNation saw how easy it was to get up on the roof , with a walkway between two buildings providing access and climbing over a small gate.

The notice of claim alleged that Utah Valley University “was well aware of the fact that students frequently accessed the very rooftop where the assassin positioned himself to take the fatal shot, as UVU employees would often find beer bottles and other trash/paraphilia on this very rooftop.”

It also alleged that UVU police had no security plan for the event, no briefing and only six police officers working the event.

“That is just gross negligence. I don’t understand how you don’t have a plan,” Walder said.

The notice of claim says Long requested approval for then-UVU President Astrid Tumine to allocate more officers, but his request was denied.

“She may have had this mindset that I don’t want police swarming my school because that is not what I want my school to look like and represent, which I understand that idea, but given today’s threat environment, domestically and internationally, you have to look past that,” Walder said.

Utah Valley University has said they are doing an independent review of their response. The findings have not yet been released.
