A New York state appeals court panel will hold oral arguments Thursday on President Trump’s bid to overrule the jury’s verdict finding him guilty on 34 counts of criminally falsifying business records to conceal a hush money payment during his 2016 campaign.

Trump argues that jurors improperly saw evidence protected by presidential immunity and prosecutors’ theory of the case is preempted by federal campaign finance law. He also says his trial judge should’ve recused himself and gave bad instructions to the jury.

The president is separately attempting to move his appeal to federal court, a push being handled separately that has so far fallen flat .

The five-judge panel on the Appellate Division, First Judicial Department will take the bench at noon EST.

Trump is at the White House, according to his daily schedule, and is not expected to attend.
