Lindsay Clancy attorney will ask for jury to be sequestered in new trial

Prosecutors have yet to make a decision on retrying Lindsay Clancy after a mistrial was declared in the case.

( NewsNation ) — Defense Attorney Kevin Reddington said he would request the jury be sequestered in a new trial for Lindsay Clancy .

Speaking to reporters, Reddington said he would ask the judge but noted that sequestration isn’t common anymore.

“I’ll request it, we’ll see what the judge does,” he said.

When a jury is sequestered, they are housed in a hotel for the duration of the trial, not allowed to access news media or coverage of the case. Judges may confiscate electronic devices like cell phones or laptops, or may monitor the use of such devices so jurors cannot access outside information.

A judge declared a mistrial in the Clancy case after a five-week trial, when jurors failed to reach an agreement after seven days of deliberation.

Clancy was facing murder charges in the deaths of her three young children. Prosecutors argued she planned to commit the crime and knew what she was doing, while Reddington told the court his client was suffering from postpartum psychosis and not criminally responsible for her actions.

The jury, made up of nine women and three men, had 11 members who found Clancy not guilty by reason of insanity and one holdout who found her guilty.

The case attracted national attention, sparking conversations about postpartum psychosis and sharply divided opinions on Clancy’s guilt.

One woman, Dawn Light , is facing charges of intimidation after allegedly taking photos of jurors exiting the courthouse.

Jury sequestration is not often used because of the high costs , logistical difficulties and burden on jurors who have to be away from their loved ones for the duration of the trial. Instead, jurors are typically instructed by a judge to avoid media coverage and to not discuss the case with anyone.

However, juries in high-profile cases, like the OJ Simpson trial, have been sequestered due to the intense amount of media coverage that might make it difficult for jurors to avoid outside information.

While Reddington said he would ask about sequestration, he also told reporters that he didn’t think it would make much of a difference and that he didn’t think the jurors were influenced by outside factors.

“I don’t believe any of these people violated the judge’s orders; they were honest, they were hardworking,” he said.

Prosecutors have not yet made a decision on retrying Clancy.
